Privacy Policy

The Fyuse App suite is owned by Fyusion, Inc. a Delaware corporation. The Fyusion Inc. Privacy Policy explains how Fyusion collects, uses, shares, and protects your information in relation to the Fyusion mobile and web services (“Service”). By using the Fyusion Service, you understand and agree to the terms and conditions of the Fyusion Privacy Policy and our Terms of Use (http://fyu.se/terms).

Fyusion has appointed an internal data protection officer (“DPO”). Our DPO’s role is to review our Privacy Policy to check that it is adequate and monitor that it is being followed in our day-to-day activities. If you wish to contact us regarding this Privacy Policy or any privacy-related matters, please contact our DPO via email at dpo@fyusion.com.

Information Collection

In the course of your access and/or use of our Service, we may collect and use the following types of information:

  • Account, Profile, and Contact information

When you create a Fyusion account, we store the username, password, and e-mail address you registered with the account. We also encourage our users to provide us with additional information such as a first and last name, a profile picture, a short description, a location, and a phone number. This optional information allows us to better respond to your requests, and makes it easier for other users of our Service to connect with you on Fyusion. You may update, modify, or delete any profile information you provide Fyusion when creating your account or subsequently updating your profile.

If you choose to authenticate using a third-party supported service such as Facebook or Twitter, we will request access to public information from the connected account to help complete your Fyusion profile.

When you choose to use third-party apps or websites that integrate with Fyusion, they can receive information about what you post. Please note that if you authenticate using a third-party supported service, information collected by those third-party services is subject to their own terms and policies, not this one.

We may use the contact information you provide us with to help connect you with other Fyusion users.

  • Finding Friends feature

Fyusion includes functionality to locate other people you might already know in our network. You can decide to use this feature by providing us with information from your phone’s contact list, by searching for names or other keywords, or by connecting your Fyusion account with other third-party services such as Facebook or Twitter. While connected to these services, you will be able to post your Fyusion content to them as well. You may disconnect your Fyusion account from the third-party services at any time.

  • Privacy Settings

You may choose to keep your privacy setting as “private”. If you are private, it gives you the ability to approve or reject any potential user of Fyusion who requests to follow you or see your posted Content. If your privacy setting for posted Content is not private, any user may be able to view your posted content through Fyusion.

  • Location information

We recommend that users provide location information in their profiles, in order to better respond to their requests, and to allow other users of our Service to connect with them more easily on Services provided by Fyusion. In addition, any of the content created in Fyusion can be tagged with location information that is either obtained automatically (if user permitted) or set and/or modified manually by the user.

We may also use location information to display Fyusion content that has been tagged near your location.

  • Device information

We may access, collect, and/or remotely store information from and about the computers, phones, connected TVs and other web-connected devices you use that integrate with our Services, and we combine this information across different devices you use. We may collect information such as your device’s unique identifier, operating system, hardware and software versions, battery level, available storage space, browser type, and mobile network information in order to help us provide better support for you.

  • Log data

When you use our Services, we automatically record log data created by your use of the Services. This data may include your Internet Protocol (IP) address, operating system and browser type, your web request, number of clicks, pages and links visited, search terms, cookie information, and other such information regarding how you interact with our Services.

Fyusion uses log data in order to measure and improve its Services.

  • Data with special protections

Unless required by law, we do not/will not ask you for any of the following types of sensitive data: race or ethnic origin; political opinions; religious or philosophical beliefs; trade union memberships; genetic or biometric data; health information; and information pertaining to your sex life or sexual orientation. However, you may choose to provide this type of sensitive data when uploading pictures and through any accompanying text. This information could be subject to special protections under the laws of your country.

Information Usage and Sharing

  • We use information that you provide us with to:
    • Make sure that our Services are working in the most effective manner for you
    • Remember information so that you won’t have to re-enter it the next time you use our Services
    • Provide you with information, products, or services that you either requested from us or have consented to be contacted for
    • Identify, diagnose, and fix problems related to the effectiveness of our Services
    • Notify you about any updates or changes to our Services
    • Verify your account and activity, and combat harmful conduct
  • People and accounts you share and communicate with

When you share and communicate using Fyusion, you choose the audience for what you share. For example, when you post an interactive 3D image, you select whether you would like to upload it publicly or privately. If you choose to make the post public, any Fyusion user may view the image.

Choosing to make the image private, and by selecting “private” on your privacy settings, allows only those users approved by you to view the image.

  • Content others share about you

You should consider who you choose to share your images with, because those who view your images can choose to share them with others on and off our Services, including people and businesses outside the audience you shared with. For example, someone with whom you choose to share an image may screenshot and share that content with others whom you never intended to see your images. Also, when you comment or like someone else’s image, your comment or like is visible to anyone who can see that person’s content.

  • Sharing with third-party partners

We will not sell or rent your information to any third parties outside Fyusion and its parent company, Fyusion, without your consent. We work with third-party partners who help us provide and improve our Services. We impose strict restrictions on how these partners can use and disclose the data we provide. Here are the types of third parties with whom we share information:

    • Measurement partners

We share information about you with companies that aggregate it to provide analytics and measurement reports for us and our partners.

    • Vendors and service providers

We provide information and content to vendors and service providers who support our business, such as by providing technical infrastructure services, providing customer service, or conducting surveys.

    • Law enforcement or legal requests

We may disclose your information to law enforcement if we are under a duty to do so in order to comply with any legal obligation (such as a search warrant, court order, or a subpoena). If upon receiving a legal request, we have a good faith belief that the law requires us to access, preserve, or share your information, only then will we do so. Additionally, if we have a good faith belief that accessing, preserving, or sharing your data will detect, prevent, or address fraud, unauthorized use of our Services, violations of our Terms of Use, or other harmful or illegal activity, we will do so.

  • If the ownership or control of all or part of our Services or their assets changes, we may transfer your information to the new owner.

Data Retention

The information provided to us can be modified by you through tools and settings available as part of our Services. If you'd like us to permanently delete Content that you have provided via Services, or permanently delete your Fyusion account, please contact our DPO at dpo@fyusion.com and we will respond in a reasonable time and process the request in accordance with our Terms of Use.

Certain information pertaining to your use of our Services may be used and disclosed, during and after the term of the Services, in aggregate. We also may use this information internally to conduct benchmark analysis or industry-based results pertaining to our Services. This aggregate information cannot be used to personally identify you, your business, or your computer.

We store data until it is no longer necessary to provide our Services, or until your account is deleted – whichever comes first. When you delete your account, we delete things you have posted, such as your images and their accompanying texts, and you will not be able to recover that information later. Information that others have shared about you is not part of your account and will not be deleted.

Should your account be terminated by you or us for any reason, subject to our Terms of Use, we will take steps to ensure your personal data is no longer stored by us, and we will instruct any third-parties with whom we have shared it to erase it, within a reasonable period of time after such account termination.

Accessing and/or Correcting Personal Data

Depending on your jurisdiction, you may have the right, free of charge, to request access to and/or make any corrections to your personal data which we hold, or to request that we delete any of your personal data in our possession. You may direct such requests to our data protection officer at dpo@fyusion.com. Once our data protection officer receives your request, and verifies your identity, we can provide you with the following:

  • A list of the personal data we have collected from you
  • A list of who, other than Fyusion or its affiliates, has had access to it
  • An explanation of if/how it was being used

Data Transfers

We share information globally, both internally within Fyusion, and externally with our partners and with those you connect and share with around the world in accordance with this policy. For example, your information may be transferred or transmitted to, stored and processed in the United States or other countries outside of where you live for the purposes as described in this policy. These data transfers are necessary to provide the services set for in our Terms of Use and to globally operate. We utilize standard contract clauses, rely on the European Commission’s adequacy decisions about certain countries, as applicable, and obtain your consent for these data transfers to the United States and other countries.

Children’s Privacy

The Fyusion Services and content are not directed at persons under the age of 13, and we do not knowingly allow such persons to register for the Service. If you become aware that your child has provided us with personal information without your consent, please contact us, and we will take steps to remove such information and terminate the child’s account.

Changes to our Policy

We may modify or update this Privacy Policy from time to time. Before implementing changes, we will notify you and give you the opportunity to review the revised policy before choosing to continue using our Services.

Your continued use of Fyusion or the Service after any modification to this Privacy Policy will constitute your acceptance of such modification. The most current version of the policy will always be available at https://fyu.se/privacy.
